As an employee working for a Company that is represented by a Union, you have the right to Union representation. If you are called into a meeting with management and you feel that the meeting or discussion could in any way lead to your being disciplined or terminated or lead to other adverse consequences:
You have the right to request a shop steward be present with you.
You should respectfully request that your Union Representative, Officer or Steward be present at the meeting.
You should state:
“With out representation, I choose to not to answer any questions”.
When the employee makes the request for a Union Representative to be present management has three options:
(1) The Company can stop questioning you until Union Representation arrives,
(2) The Company can call of the interview,
(3) The Company can tell the employee that it will call off the interview unless the employee voluntarily gives up his/her rights to a Union representative (an option the Employee should always refuse).
Management is not required to inform the employee of his/her Weingarten rights: it is the employee’s responsibility to know and request.
Always make sure that you request a Union Steward!!!!
